Introduction

Fencer ("we," "us," "our," or "Company") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our mobile applications (Fencer iOS and Fencer Android) and any associated services.

Information We Collect

We collect information in various ways, including:

  • Personal Identifiers: Email address, name, and other account information you provide when you create or use your account.
  • Usage Data: Information about your interactions with the app, including features used, content preferences, and engagement patterns.
  • Device Information: Device type, operating system version, unique device identifiers, browser data, and device settings.
  • Network Information: IP address and other network communication data.
  • Performance Data: App performance metrics and crash data to improve our services.
  • Analytics and Tracking: We use SDKs and tracking technologies for analytics, personalization, and advertising purposes.

Legal Basis for Processing (EU/UK Users)

We process your personal data based on the following legal bases:

  • Contract Performance: Processing necessary to provide and maintain our services.
  • Legitimate Interests: Processing for service improvement, analytics, security, and fraud prevention.
  • Legal Obligations: Processing required by applicable laws and regulations.
  • User Consent: For non-essential tracking, marketing communications, and personalized advertising.

We use the information we collect to:

  • Provide and maintain the Fencer app and services
  • Improve, personalize, and expand our services
  • Understand how users interact with the app
  • Respond to your inquiries and provide customer support
  • Monitor and analyze usage patterns and trends
  • Detect, prevent, and address fraud, abuse, and other technical issues
  • Send analytics, personalization
  • Comply with legal obligations and regulatory requirements

Data Retention

We retain your personal data for as long as necessary to provide our services and fulfill the purposes outlined in this Privacy Policy. Data retention periods align with statutory requirements and the necessity of the processing. You may request deletion of your data at any time, subject to legal exceptions and legitimate business needs.

Competition participation records: When you participate in a competition, a record of your participation — including your name as provided at the time — is recorded as part of that competition's results. This record is shared with all other participants and the competition host, and forms part of the historical integrity of the event.

If you delete your account, your personal profile and all directly associated data are permanently deleted. However, your participation records in past competitions are retained for the accuracy of those competition results. These records are de-linked from your account upon deletion — they are no longer associated with any user identity in our system — but the name snapshot recorded at the time of participation will remain as part of the competition history. This retention is based on our legitimate interest in maintaining accurate historical records for all participants of a competition.

Data Sharing and Disclosure

We do not sell, trade, or rent your personal information to third parties for their independent marketing purposes. We may share your information only in the following circumstances:

  • Service Providers: We share information with third-party service providers in hosting, analytics, payment processing, and security who assist us in operating the app. These providers are bound by confidentiality agreements and use data only for specified purposes.
  • Legal Requirements: We may disclose information when required by law or to protect our legal rights and the safety of our users and the public.
  • Business Transfers: If Fencer is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

International Data Transfers

Your personal data may be transferred to, and processed in, countries other than your country of residence. These countries may not have data protection laws equivalent to those in your home country. When we transfer data internationally, we implement appropriate safeguards including the use of EU Standard Contractual Clauses and UK Data Protection Act supplementary measures to ensure adequate protection of your personal information.

Data Security

We implement appropriate technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. This includes encryption, secure authentication, and regular security assessments. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

Your Rights and Choices

Depending on your location, you may have certain rights regarding your personal information:

  • Right to Access: You have the right to access the personal information we hold about you.
  • Right to Correction: You can request corrections to inaccurate or incomplete information.
  • Right to Deletion: You have the right to request deletion of your account and associated personal data. You can initiate this process on our Delete Account page. Please note that competition participation records are retained after account deletion as described in the Data Retention section above.
  • Right to Data Portability: You may request a copy of your data in a structured, commonly used format.
  • Device Settings: You can control ad tracking through your device settings.
